In Russia have forbidden to apply a death penalty
The constitutional court of Russia has born the decision according to which the death penalty in the country not can to be applied even after the moratorium on the maximum measure of punishment.
The moratorium on a death penalty expired on January, 1st, 2010 with introduction of a jury in last region of Russia – the Chechen republic. After that formal obstacles for purpose of a death penalty in the country any more would not be.
Nevertheless, the Constitutional court has considered, that introduction of a jury in all territory of Russia does not open an opportunity of application of a death penalty.
The decision of court, the moratorium on a death penalty is prolonged before ratification of the Russian Federation of the report on its cancelling.
As chairman КС has declared the Russian Federation Valery Zorkin, has subscribed under some international norms which forbid or recommend to forbid application of a death penalty. As he said, in members of the Council of Europe Moscow have invited only after the promise to cancel a death penalty.
The question on preservation or cancelling of the moratorium on the maximum measure of punishment has arisen in the end of October when in КС the Russian Federation behind explanations the Supreme court of Russia has addressed. Judges ВС the Russian Federation were afraid of occurrence since January, 1st, 2010 of legal uncertainty.
On November, 9th on public meeting КС representatives of all branches of authority have supported preservation of the moratorium.
The moratorium on a death penalty has been entered into Russia per 1999. Last criminal was kiled in Russia on September, 2nd, 1996.
